Pursuant to and in accordance with Articles 13 and 14 of EU Regulation no. 2016/679 (hereinafter, “GDPR”)

This Privacy Policy is intended to describe the management of personal data collected by Enersystems S.P.A. through this website, in accordance with the applicable regulation. You can print or save this document using the functionality of your Internet service program (=browser: usually “file” > “save as”).

Collection of personal data

The personal data that may be collected are as follows:

  • – Personal data for site registration to open a customer account
  • – data on the customer account page related to order fulfillment and the purchase method chosen by the user
  • – e-mail address for receiving newsletters
  • – Personal data provided to receive specific assistance
  • – navigation data
  • – Cookies, for details of which, please refer to the Cookie Policy on the website
  • – Statistical, non-personally-attributable data related to viewing the site
  • – Pseudonymized profiling data associated with personalized user advertising

Optional provision of data

Except as specified for the navigation data, the user is free to provide personal data required by Enersystems S.P.A. to use the web services made available by the Company, subject to consent to this policy. Failure to provide them may result in the inability to obtain what is requested.

Regarding cookies, for which we refer in detail to the cookie policy, the user has the option at any time to block them.

For the sake of completeness, it should be mentioned that in some cases (not the subject of the ordinary management of this site) the Authority may request news and information, for the purpose of monitoring the processing of personal data. In these cases the response is mandatory under penalty of administrative sanction.

Regarding the “stay logged in” function, designed by the Company to make viewing the site as pleasant as possible, it is up to the user to make it active; in any case, the password is requested for possible modification of personal data and/or to place an order.

Purpose and manner of processing

Personal data collected (“Data”) may be processed for the following purposes:

  • – With the consent of the data subject, execute a specific request of the user;
  • – with the consent of the data subject, send newsletters with commercial and/or promotional information on products and services of the Company, (“Marketing”);
  • – with the consent of the data subject, allow the Company to perform user profiling in pseudonymized form to improve the shopping experience by making it personalized. The Data may
  • – be processed by paper and/or electronic and automated means, in particular, by regular mail or email, telephone (e.g., automated calls, SMS, MMS), fax, and any other computer channel (e.g., websites, mobile app);

Other parties who may process data

Data may be processed by individuals working on behalf of the Company and under specific contractual obligations. Data may also be disclosed to third parties to fulfill legal obligations, to comply with orders from public authorities, or by prior consent or to exercise a right of the Company in court.

Transfer of data outside the European Economic Area (EEA)

The Company currently does not transfer data outside the European Economic Area or provide it to international organizations.

The user’s personal data passing through the Company’s site is handled securely through the SSL (Secure Socket Layer) encryption system: this applies from login to order fulfillment to data maintenance.

Linking to third-party websites

Third-party Web sites accessible from this site are the responsibility of those third parties. The Company disclaims any responsibility for requests and/or provision of personal data to third-party websites.

Data retention

  • – The Data processed to provide the Service will be retained by the Company for the period deemed strictly necessary to achieve those purposes, except in the event that it needs to handle any disputes related to the provision of the Service, which would be retained until that process is completed.
  • – Customer Account Data are kept for ten years after the user’s last use of the service.
  • – Data processed for Marketing purposes will be retained by the Company from the time the data subject has provided consent until such consent is revoked. Should consent be withdrawn, a longer retention time could be used for such data, as in the previous case, in order to handle possible disputes and/or litigation.
  • – Data processed to improve user experience on the Websites will be retained for the periods specified in the Cookie Policy.

The rights of the data subject

The data subject is granted the following rights:

  • – Right of access, i.e., the right to obtain confirmation from the Company that Data is or is not being processed and, if so, to obtain access to it;
  • – Right to rectification and erasure, i.e., the right to obtain rectification of inaccurate Data and/or supplementation of incomplete Data or erasure of Data for legitimate reasons;
  • – Right to restriction of processing, i.e., the right to request the suspension of processing if there are legitimate grounds;
  • – Right to data portability, i.e., the right to receive in a structured, commonly used and readable format the Data, as well as the right to transmit the Data to another data controller, if provided;
  • – Right to object, i.e., the right to object to the processing of Data if there are legitimate grounds, including the processing of Data for marketing and profiling purposes, if any;
  • – Right to receive information about data breaches concerning him or her.

Changes

This Privacy Policy was updated on 2/20/2024. The Company reserves the right to partially or fully amend the Privacy Policy or simply update its content (e.g., due to changes in applicable law), following which, the Company will post any updates on this website.
